My name is Tony Del Vecchio. I am what is known these days as a left-behind parent.
Upon divorce in Japan, only one parent receives what is known as “shin ken” (parental rights). That parent then assumes all legal rights with respect to the upbringing of the couple’s child(ren) born of the marriage. The other parent loses any and all parental rights.
In addition, there is no provision for child visitation under Japanese statute, and no contempt of court provisions. This means that even if the court were to render a visitation judgment, it would be unenforceable both from the standpoint of the statutory law itself and from the point of view of the court’s ability to compel the party or parties to perform.
Myself and a dedicated group of other left-behind parents are working to change things here in Japan and establish a system of Joint Custody under the law so that the fundamental human rights of both parents, and the right of the child to see both parents, are protected.
